Terms of Service
Last updated October 24, 2026
1. Who we are
MILÉA is a brand of [Legal business name, e.g. Miléa LLC], a Michigan business ("MILÉA", "we", "us"). These terms apply when you use this website, join our first-order list, place an order, or book the MILÉA Cart. When you place an order, you agree to these terms.
2. The first-order list
MILÉA is coming soon. When you join the first-order list, you tell us what you are interested in. It is not an order and it does not reserve a date. You do not pay anything, and you can leave the list at any time. When orders open, we contact you first.
3. Orders and quotes
Each piece is made to order. We confirm every order in writing with the design, the price, the deposit, the balance due date, and the pickup, delivery or event details. An order is booked only when you accept that confirmation and we receive your deposit.
Dates are limited because we make each bloom by hand. We book dates in the order that deposits arrive.
4. Deposits and payment
- A deposit of [50]% of the order total reserves your date. The deposit is non-refundable, because we hold the date for you, turn away other orders, and buy materials for your design.
- The balance is due [7] days before pickup, delivery or your event, unless your confirmation states another date.
- We may release a date if the balance is not paid on time.
- A third-party payment processor takes card payments. We never see or store your full card number.
5. Changes, rescheduling and cancellations
- Changes. You can change colors, flowers or flavors up to [14] days before your date. After that, we make changes only if time and materials allow. A change can change the price.
- Guest count. For events, give us your final guest count [14] days before the event. We can add to an order after that if we have time, but we cannot reduce it.
- Rescheduling. With at least [14] days' notice, you can move your deposit once to another open date within [6] months.
- Cancellation. If you cancel, we keep the deposit. If you cancel fewer than [7] days before your date, the full order total is due, because your flowers are already made.
- If we must cancel. If illness, an emergency or a safety problem stops us, we offer a new date or a full refund of what you paid.
6. Handmade work and colors
Every bloom is piped by hand, so no two are the same. Shapes, sizes and shades can vary a little from photos, screens and color swatches. We match your palette as closely as we can. These small differences are part of handmade work and are not a reason for a refund.
Some images on this website show the style of our work and may not be photos of a specific past order.
7. Ingredients, allergens and diets
Our marshmallow is made with sugar and gelatin, so it is not vegetarian or vegan. Our kitchen also handles [list allergens handled, e.g. milk, eggs, tree nuts]. We give a full ingredient and allergen list on request before you order.
We cannot promise any product is free of allergens. You must tell us about allergies and diets before you order, and you are responsible for telling your guests and recipients. Do not eat our products if you are unsure whether they are safe for you.
8. Parts you cannot eat
Only the marshmallow flowers are food. Stems, wires, picks, floral tape, wraps, ribbons, cards, boxes and display pieces are not edible. Remove them before you eat. Small parts can be a choking hazard. Keep them away from small children and pets, and supervise children when they eat.
9. Storage and care
Marshmallow softens in heat, sun and humidity. Keep your flowers cool and dry, out of direct sun, and follow the care card that comes with your order. Do not refrigerate them unless the care card says to.
We are responsible for your order until it is picked up or delivered. After that, we are not responsible for damage from heat, humidity, handling, transport or storage.
10. Pickup and delivery
- We give you a pickup or delivery window in your confirmation. Please be on time, because our products are perishable.
- For delivery, someone must be there to receive the order. If no one is there, we may leave it in a safe place or return it, and a new delivery fee may apply.
- Check your order when you receive it. If something is wrong, tell us the same day with a photo.
- We sell and deliver within Michigan only.
11. The MILÉA Cart at events
- Access. We need access to the event space at least [60] minutes before service starts, a level space near the entrance, and a clear path for the cart.
- Power. Espresso service needs a standard outlet within [50] feet of the cart.
- Weather. For outdoor events, the cart must be under cover and out of direct sun. Heat and rain damage marshmallow. If the site is unsafe or unsuitable, we may move the cart or shorten service.
- Venue rules. You are responsible for venue approval and any venue fees. Tell us about venue rules before the event.
- Service time. Setup and breakdown are not part of your service time. Extra time is billed at the rate in your confirmation.
- Safety. We may stop service if guests or the site put people, the cart or our staff at risk. In that case, no refund is due.
- Damage. You are responsible for damage to the cart caused by guests.
12. Photos and social media
We may photograph our work and share it on our website and social media. We do not post photos of guests' faces without permission. If you do not want your order shared, tell us before your date and we will keep it private.
If you tag @mileaflower, we may share your post with credit to you.
13. This website
The text, photos, designs and logo on this website belong to MILÉA. Do not copy or use them without our written permission. We try to keep the site accurate, but details can change. Your order confirmation controls over anything on the website.
14. Limits of liability
To the fullest extent the law allows, our total liability for any claim about an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms limits any right you have that the law does not allow us to limit.
15. Governing law
Michigan law governs these terms. Any dispute goes to the courts of [County] County, Michigan. Before any formal claim, please contact us so we can try to make it right.
16. Changes and contact
We may update these terms. The date at the top shows the latest version. The terms in force when you place an order apply to that order.
